At a AEI event on Tuesday Supreme Court Justice Antonin Scalia was heckled by at least four people when he took questions. One heckler called the AEI and Scalia “Nazis” as he was being removed from the event. Several of the infiltrators chastised the Cheney hunting incident instead of asking a question and they were eventually silenced.

BREITBART – New Supreme Court Justice Samuel Alito split with the court’s conservatives Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri’s last-minute request to allow a midnight execution.
The court’s split vote Wednesday night ended a frenzied day of filings. Missouri twice asked the justices to intervene and permit the execution, while Taylor’s lawyers filed two more appeals seeking delays.
Oh geez, what’s next? I bet it’s our civil liberities.

Pat Buchanan and Bob Shrum appeared on “Hardball” with Chris Matthews earlier this evening. The trio discussed a possible Alito filibuster that was called by Kerry yesterday, but reported today. Unsurprisingly, Shrum agreed whole-heartedly with Sen. Kerry and subsequently, agreed with the destruction of his party. Pat Buchanan said that he is all for Democrats filibustering Alito because it would bring about the nuclear option and therefore the Democrats would be unable to block another Supreme Court nominee and to a lesser extent, a federal court nominee. This was one of the very few occasions I have agreed with (other times include the border, national security, and, wiretapping terrorists, and immigration) Pat.
During the interview, Shrum attacked Alito saying that he is an “extreme right-winger” that will “vote to strike down a woman’s right to choose”. He also attacked his wife by making fun of the crying incident. The debate between “extreme left-winger” Shrum and Buchanan got very heated.

At the beginning of the 4pm hour of CNN’s The Situation Room, Congressional correspondent Ed Henry reported that Senator John Kerry (D – MA) is calling for an Alito filibuster. Henry says that the Senior Senator from Massachusetts, Sen. Ted Kennedy (D) is also calling for a filibuster and is asking his colleagues to join the two. However, already three Democrats (Byrd, Nelson (Nebraska), and Johnson) have joined the Republicans in a vote for Alito. The ‘Gang of 14’ has already said that they do not plan to filibuster Alito, which means the rest of the 7 Democrats will probably join the vote against a filibuster.

A few hours ago President Bush spoke to the NSA about wiretapping terrorists and the nomination and confirmation of Judge Samuel Alito. Bush talked about Alito’s qualifications, support from his interns, and why he should be on the court. 51 of 54 Alito’s past clerks have out in support for the Judge. The 3 other clerks do support Alito, however they can’t publicly speak about their approval due to restrictions in their profession.
