    Most people would not classify his fame as such. He really has become a DC fixture. He has been around a long time.

There was no violation of the Agent Identities Protection Act or of any other national security law in the revelation that Joe Wilson’s wife was a CIA employee (a Washington D.C. desk bound analyst) who arranged Joe Wilson’s trip to Niger. Among many things, Valerie Plame Wilson was not “covert” within the meaning of the Agent Identities Protectin Act as she did not have the requsite foreign posting and undercover assignment within the last five years. That is why Fitzgerald never indicted anyone for violating the Agent Identities Protection Act or of any other national security law.

    In fact, the revelation of the identity of Joe Wilson’s wife was really the result of Joe Wilson’s own doing. Think about the chronology: (1) Joe Wilson, on a trip arranged by his wife, goes to Niger on a CIA financed trip and comes back giving an oral report that Saddam was up to something in Niger; (2) Joe Wislon writes a scathing op-ed column in the NY Times accusing the Bush Adminstration of lying for citing British intelligence that Sadddam was seeking yellow cake uranium in Niger because he (Wilson) had been sent on a fact-finding mission to Niger since the Vice President’s office was interested in the matter and had submitted a report that Saddam was up to no such thing in Niger; (3) Given the clear implication in Wilson’s op-ed column that he had been sent to Niger by Vice President Cheney (reported as fact by ABC News and CNN) and the Vice President and his staff knowing that Cheney had certainly not sent Wilson, Bush Administration officials wonder who had in fact sent Wilson, a known left wing Democrat around Washington D.C.; (4) Novak wonders about the same question and learns that Joe Wilson’s wife worked at the CIA and had been involved in selecting Joe Wilson, a possible violation of anti-nepotism law; (5)Novak looks up Joe Wilson in Who’s Who and learns that Valerie Plame is his wife; (6) Noval confirms with the CIA that Valerie Plame works with the CIA but was not told that she was undercover (because she wasn’t); (7) Novak publishes his column on who sent Wilson to Niger (Wilson’s wife); (8) Wilson and the NY Times go nuts and demand a special prosecutor; (9) a special prosecutor is appointed and does a 2 1/2 year investigation; (10) menawhile, the Senate Intelligence Committee holds hearings on the issue and issues a report without dissent finding that Wilson had been sent to Niger by his wife and that Wilson had not submitted a written report saying that Saddam was not trying to buy yellow cake uranium in Niger but rather had orally reported that Saddam was interested in something in Niger (the only thing that Niger has of interest to Saddam, incidentally, is yellow cake uranium); (11) the supplemental report by the Senate majority members of the Intelligence Committee finds that Wilson had lied; (12) Saddam government documents uncovered after the removal of Saddam show that British intelligence was right, that Saddam was attempting to buy yellow cake uranium in Niger; (13) Fitzgerald only indicts one person in Scooter Libby and not about the leak at all but for alleged perjury based on different recollections of Libby and reporters about conversations they had (Libby may win that one); (14) Fitzgerald releases Novak at what appears to be the conclusion of his investigation, freeing Noval to talk; (15) Fitzgerald had the name of Novak’s original source from the beginning and did not indict.

    In the end, what I think happened is that excessive partianship and disingenuous behavior by Joe Wilson and the NY Times led to what really offended the First Amendment. In the context of political arguments over the decision to launch the Iraq War, Joe Wilson penned an op-ed piece published by the New York Times containing false information that became the subject of a Novak column that exposed part of the falsity. Also, the Bush Administration declasified certian information that also called into question the Wilson op-ed column’s assertions about what was going on in Niger. Yet, that political debate got dragged into a criminal investigation as to possible violation of laws that were actually written and interpreted not to apply in this kind of situation and not to interfere with political debate.
